PLEASE READ THE TERMS OF THE FOLLOWING POLICIES CAREFULLY BEFORE USING THE DPS WEBSITES.
The policies below describe the Darien Public Schools’ (“DPS”, “us,” “our”, or “we”) agreement with you when you visit any of our websites (“you”) hosted under the domains www.darien.k12.ct.us, www.darienps.org or any other domains administered by the Darien Public Schools (the “DPS Websites”). By using the DPS Websites, you signify your agreement to these policies. If you do not agree to these policies, you may not use the DPS Websites.
NOTICE TO CHILDREN UNDER THE AGE OF 13 AND THEIR PARENTS OR LEGAL GUARDIANS: IF YOU ARE UNDER THE AGE OF 13, YOU ARE STRICTLY HEREBY PROHIBITED FROM SUBMITTING PERSONAL INFORMATION ON THE PBS WEBSITES EXCEPT THROUGH YOUR PARENTS OR LEGAL GUARDIAN WITH THEIR KNOWLEDGE AND CONSENT.
DPS DOES NOT KNOWINGLY COLLECT PERSONAL INFORMATION FROM CHILDREN UNDER THE AGE OF 13 AND CHILDREN UNDER THE AGE OF 13 ARE SPECIFICALLY PROHIBITED FROM SUBMITTING ANY PERSONAL INFORMATION ON THE DPS WEBSITES. IF YOU ARE UNDER THE AGE OF 13, DO NOT SEND DPS ANY PERSONAL INFORMATION INCLUDING WITHOUT LIMITATION YOUR EMAIL ADDRESS, NAME AND/OR CONTACT INFORMATION. IF YOU WOULD LIKE TO CONTACT DPS PLEASE ONLY DO SO THROUGH YOUR PARENTS OR LEGAL GUARDIANS.
If you are not under the ages of 13 and voluntarily submit personal information, we may collect such personal information. For example, if you choose to fill out one of the forms on our PBS Websites to register to receive information or to attend a meeting, we retain the information submitted to enroll you or to provide you with the requested information. After we have taken the appropriate action in response to your submittal, we may retain the information you submit for our records.
Receiving Promotional Materials: We may send you information or materials such as newsletters or notices of meetings or classes by e-mail or postal mail to the names and addresses you voluntarily submit to us.
Links to Other Websites: DPS is not responsible for the practices or policies of the websites linked to or from the DPS websites. If you elect to use a link that accesses another party’s website, you will be subject to that website’s practices and policies.
Accuracy of Information:
The information contained on our DPS websites has been obtained from sources believed to be reliable. While we strive for accurate and up-to-date information on the DPS Websites and while the site is regularly maintained, we cannot warrant the absolute accuracy of information at a specific point in time. All information on the DPS Websites are provided "as is" without any representation of any kind, including as to its ultimate fitness or suitability for any particular purpose or as to the accuracy, completeness or adequacy of such information. If any information you are using on the DPS Websites requires an absolute assurance for any reason as to its accuracy, please consult directly with the appropriate persons and/or examine primary source materials.
Under no circumstances will DPS be liable for any direct, incidental, consequential, indirect, special or punitive damages whatsoever (including without limitation, costs and expenses of any type incurred, lost profits, lost
data or programs, and business interruption) arising out of your access to, use of, inability to use, or the results of use of the DPS Websites or any web sites linked to or from the DPS Websites or any claim attributable to errors, omissions or other inaccuracies in our DPS websites or any websites linked to or from the DPS Websites or interpretations thereof.
You agree to indemnify, defend and hold harmless DPS, its affiliates and their respective officers, directors, employees and agents from and against all losses, expenses, damages and costs, including reasonable attorneys'
fees, arising out of your use of the DPS Websites.
Notification of Claims of Infringement:
A copyright owner or an agent thereof who believes that any user submitted information or other content infringes upon such copyright owner’s copyrights may submit a notification pursuant to the Digital Millennium Copyright Act (“DMCA”) by providing the DPS Websites’ Copyright Agent (identified below) with the following information in writing (see 17 U.S.C 512(c)(3) for further detail):
(i) A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
(ii) Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
(iii) Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled and information reasonably sufficient to permit the Copyright Agent to locate the material;
(iv) Information reasonably sufficient to permit the Copyright Agent to contact the owner or its agent, such as an address, telephone number, and, if available, an electronic mail address;
(v) A statement that the owner has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
(vi) A statement that the information in the notification is accurate, and under penalty of perjury, that the copyright owner or its agent is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

III. General Terms:
Legal Provisions: If any provision of these policies is determined by a court of competent jurisdiction to be invalid, all other terms and conditions shall remain in full force and effect. These policies and the resolution of any dispute arising hereunder shall all be governed and construed in accordance with the laws of the state of Connecticut, without regard to its conflicts of law principles. You consent to the jurisdiction of the courts of the state of Connecticut.
